Ex Parte (pronounced ex par-tay) is a method of filing used to expedite particular Family & Civil filings with the court, when immediate judicial intervention is necessary — such as to prevent harm or preserve rights.

 

Some common requirements for Ex Parte requests:​

  • The application must identify the relief requested and the basis for urgency (irreparable harm, immediate danger, risk of loss) rather than a regular motion calendar. 

  • A Declaration setting out facts from personal knowledge, showing the emergency, the status quo, and whether prior applications/relief exist. 

  • A Proposed Order (draft) for the judge to sign if the Ex Parte is granted. 

  • Notice to the opposing party of the application: the nature of the relief sought, where and when it will be heard, and an attempt to check whether the opposing side will oppose. If shorter notice is requested, explanation must be provided. â€‹

  • Payment of applicable filing fees (or a fee waiver if eligible). 

  • Check and comply with the local court’s ex parte calendar rules: when the clerk must receive papers, any department assignments, e-filing or paper filing rules.

Family 

  • The case must already exist (or be filed concurrently) in the family law division before an ex parte emergency order may be requested.

  • If served on the Opposing party before 10am, then it must be submitted to the Court before 10am the next day. 

  • If served on the Opposing party after 10am, then it can be submitted to the Court any time the next day or before 10am the following day.

  • A correct indication on the FL-300 Request For Order that this is an Ex Parte request, and the inclusion of the FL-305 Temporary Emergency Order, and the FL-303 (if/when required).​

  • If the request involves custody or visitation, must include: the date(s) of incident(s), description of harm or risk, current order or living arrangement, and UCCJEA declaration (form FL-105) if jurisdictional facts apply.

If you are requesting same day Filing of your Ex Parte documents, our office must receive the entire packet of documents by 8:30am.

Incomplete document packets or requests received after this time may not be submitted same day, and may also incur additional RUSH fees.

When Sending Your Request:

  • Ensure all Exhibits are separate pdf's, and labeled accordingly e.g. Exhibit 1, Exhibit 2 etc.

  • Include an Exhibit List for the beginning of the binder, as well as a Cover sheet for the outside.

  • Load all files into a Cloud platform e.g.Google Drive, DropBox, Microsoft OneDrive etc, and send us the Link.

  • If Color copies are required, please list all Exhibits.

  • Need it in 24hrs or less? Additional fees may be applicable.
